CERTAIN CONDITIONS MAY INDUCE A PREVIOUSLY UNKNOWN CONDITION OR UNDETECTED EPILEPTIC SYMPTOM IN USERS WHO HAVE SHOWN NO HISTORY OF ANY PRIOR SEIZURE OR EPILEPSY. SECTION 17 - ENTIRE AGREEMENT

 

This Agreement constitutes the entire agreement between you and Viyeshiere Lucre and shall govern the use of our Services, superseding any prior version of this Agreement between you and us with respect to Viyeshiere Lucre Services. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other Viyeshiere Lucre Services, affiliate Services, third-party content or third-party software.

 

SECTION 18 - CHOICE OF LAW AND FORUM

 

It is at the mutual agreement of both you and Viyeshiere Lucre with regard to the Agreement that the relationship between the parties shall be governed by the laws of the state of New York without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the Agreement, or the relationship between you and Viyeshiere Lucre, shall be filed within the courts having jurisdiction within the County of Bronx, New York or the U.S. District Court located in said state. You and Viyeshiere Lucre agree to submit to the jurisdiction of the courts as previously mentioned, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

 

SECTION 19 - WAIVER AND SEVERABILITY OF TERMS

 

At any time, should Viyeshiere Lucre fail to exercise or enforce any right or provision of the Agreement, such failure shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect.

 

SECTION 20 - NO RIGHT OF SURVIVORSHIP NONTRANSFERABILITY

 

You acknowledge, understand and agree that your account is non-transferable and any rights to your ID and/or contents within your account shall terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

 

SECTION 21 - STATUTE OF LIMITATIONS

 

You acknowledge, understand, and agree that regardless of any statute or law to the contrary, any claim or action arising out of or related to the use of our Services or the Agreement must be filed within 1 year(s) after said claim or cause of action arose or shall be forever barred.

BOOKING & PAYMENT OPTIONS

We only allow selected candidates to book us for meetings, pickup appointments, interviews and consultations. To schedule an appointment prospect has to be referred directly from HR [Human Resources]. We cannot proceed with an appointment without an approval therefore, we encourage interested prospects not to schedule an appointment randomly without approval from our HR department and consent, we will not participate. All pickups must be scheduled through our square booking page found in our help / claims & disputes section, to reserve the requested date & time. Due to high volume of demands for pickups it is mandatory after booking a reservation all pickups scheduled has to be confirmed and receive a confirmation code or number for further use, to receive a confirmation code/number visit our claims and disputes section and submit the form from order pickup only. There are multiple payment options available for customers that are limited with their daily schedule. We now have an order pickup option for customers who prefers to collect items in person that are in close proximity of our conducting operation. We also provide manual payments also known as offline payments in digital form; cash app/zelle for customers who uses those platforms. Our offline payments are only for in-person transactions. PRE-ORDERS

Due to high demand selected orders, pre orders will take an extra 3-7 days to ship after release. All pre-orders usually take up to 2-3 weeks for release then shipped. Pre-orders have specific release dates when items are going to be in stock. Due to major changes within the shipping industry, shipping carriers may delay orders. We advise all shoppers and our members to be patient orders will arrive and regulate in timely manner. Tracking is provided immediately after an order was shipped. Every tracking number will be sent via email to the email provided in order after it was placed. Please be advised that any missing emails check spam account or contact us as soon as possible. Out of stock orders will get canceled and refund will be processed right away allow up to 3-7 business days.  ORDER PICKUPS

 

This option cannot be canceled once chosen at checkout. We do not reserve an order for more than 4 days. If order is not picked up within 4 days of scheduling there will be a charge of $5 per day, the maximum holdings is up to 14 days then order will be shipped. We allow cancellation of pickup appointment once scheduled. First reschedule fee for pickup  is waived due to 1-time occurrence grace. The 2nd reschedule for pickup has a surcharge of $10 for reschedule. Reschedule fee is only waived by appeal and approval from our HR department. We have a 5 hrs. daily window to schedule all pickups appointment. All pickups must be scheduled during its designated time. Please schedule pickup within 24 hrs. of order being placed. Failure to schedule within 24 hrs. of purchase will result in order being shipped. All pickups have a $5 surcharge fee for reservation. Please wait for HR approval or confirmation code before showing up. All appointments scheduled will receive a confirmation code/number [HR referral] via email confirming pickup appointment. Confirmation no. and I.D is mandatory for all pickups. Allow 3-7 business days for pickup to be ready. Cancelling a pickup within 6 hours of appointment will result in a $10 late cancellation fee/$10 reschedule fee. EXCHANGE & RETURNS

Exchanges are based on returns, for an exchange to take place an order must be returned fully following the correct sequence of order return, accepted to receive equal store credit or refund. REFUND POLICY

We issue cash back solely on orders that have been canceled within 24 hours of purchase that is expressed in our cancellation policy, fraud orders and internal errors {out of stock items, mistakes} all other refunds are granted in the form of store credit. It takes 3-7 business days on all cash back to appear in account and 2-5 days for all store credit to appear in email or lucre card.

1. CANCELLATION POLICY

 

All orders must be canceled strictly within 24-hours, except for pre-orders which is within 7 days. If an order has not been canceled within 24-hours, transaction will be valid. Absolutely no cancellation after time has exceeded deadline. Pre-orders cancellation will not exceed 7 days. 

All canceled orders per customer's request that are within deadline will be processed and refunded in the form of original payment. Please allow 3-7 business days for credit to appear in account.

2. APPOINTMENTS & CANCELLATIONS

 All appointment cancellation window is strictly 6 hours prior to appointment, failure to cancel within cancellation period will result in a 25% fee surcharge for reschedule of meeting except for pickup appointments. First reschedule fee for pickup is waived due to one time occurrence grace. The 2nd reschedule for pickup has a surcharge of $10 for reschedule. Reschedule fee is only waived by appeal and approval from HR. We allow cancellation of pickup appointments once scheduled. Any cancellation under 6 hours will result in a $10 late cancellation fee no exception. All first-time members/customers/clients are entitled to a 1-time fee waiver for occurrence. HOW WE TAX?

 

We collect tax on all orders. Each state in the U.S has different taxation. Special taxes will be included on items that are delicate and fragile to ship because of special services and handling when shipping. We utilize an automation system that calculate taxes for U.S states. Some states are exempt from Viyeshiere Lucre automated tax system because of the special tax rules and regulations that each of those states have. Some states are subjected to more taxes than others due to the tax stipulations under each state. There is a unique tax system set in place for each state required tax percentage; no tax on orders is fixed, they will fluctuate based on the automated system. We will try to compromise taxes with coupon codes and discounts to help customers with overall cost of their purchase. Some states are home rule states.

INTERNATIONAL ORDERS & SHIPPING

 

We collect tax for all international orders. No country outside of the U.S will be exempt from taxation. We will try to accommodate all international orders with special discounts on orders and promo codes to give customers' outside the U.S equality and a relief. We consider all the disadvantages international shipping and taxes create; we will provide a fixed standard shipping cost for all international orders. Each country has its own taxation; percentage varies per country. We employ an automated system for all taxes outside of the U.S as well as in; for all international order and shipping taxation. All international orders might be subjected to special taxes depending on item being shipped due to the shipping and handling policy with delicate items. SPECIAL CIRCUMSTANCES

Our no-fault rule falls under this category. Any order that underwent a dilemma outside our company's hands or consumers, is ruled as a no-fault to consumer. Not every order is deemed under this category, orders that were processed without any reported issue will be valid and excluded from any refund, only store store credit will be granted unless otherwise expressed under the refund policy. We only issue store credit on the following categories that guarantees credit under our no-fault rule, they are as follow;

lost/stolen packages,

damaged packages,

1day shipping/overnight delays 

internal error orders (wrong item/order sent etc.).

Packages that are lost/stolen is eligible for 100% store credit whether the order is insured or not.

Under our damage category it is differentiated in two areas; insured and uninsured. All customers with damaged packages/orders have the option to return or keep merchandise with them assuming responsibility for return shipping and fees. If customer returns damaged merchandise they will receive maximum of 90% in store credit, this rule applies to both insured and uninsured orders. If customer with insured order/package keeps merchandise 30% is non-refundable due to shipping cost and fees. Customer's with uninsured packages/orders are only eligible for 50% store credit if they keep merchandise, the following 50% is non-refundable due to shipping cost and fees including package not being insured to cover all fees from damages incurred by third party. We urge our customers and shoppers to insure their orders to prevent them from the damage fee experience. When an order is not insured both our company and customer assume the risk, therefore we both suffer a loss in such events; loss of merchandise and money. We sympathize with all our customers that undergo this loss due to unfortunate series of events that are forthcoming with online shopping. We will help our customers combat such catastrophe the best way we can by crediting customer by store credit or refund. For fraud and internal error orders (mistakes by company) will be refunded via original payment, it takes 3-7 business days before credit appears back in account. As for 1 day shipping/overnight delays customers will receive 5% credit back in the form of original payment for delays. Due to the agreement we did not fulfil it is deemed as no-fault to the consumer. We understand the urgency for 1 day shipping/overnight and for that matter we will refund 5% back to ease the frustrations that stem from delays and cost. This resolution will not be ideal to every customer who are in the exact predicament we stated above; and for that we do apologize. We care for our customers and appreciate them, therefore we cannot be selfish.

Please read our refund policy. Once an order is placed it cannot be altered or changed. Please email us with any concerns regarding your order. No refund will be issued if order has no reported issues, under guaranteed or no-fault rule, please read our no-fault rule under our special circumstances policy. Due to Covid-19 returns and exchanges are limited to 7 days after delivery, it will not be accepted after 7 days. Our standard return of 14 days will resume shortly.  Returns & exchanges will not be granted without approval or approval code from the returns department, a return form has to be filled out. Do not send back package without expressed or written consent, no refund will be issued. Exchange goes hand in hand with returns, only eligible orders can be returned for an exchange or store credit. For cancellations, orders must be canceled strictly within 24-hours via returns form, email or phone no exception, if an order has not been canceled within the 24-hour time frame; transaction will be valid. Absolutely no cancellation after time has exceeded our deadline.

In most cases we only issue store credit, we do have a strict rule in place if we must issue otherwise. Customers can add a note for special instructions at checkout section. All insured packages credit are issued either by; full store credit or split part store and original payment based on customer's preference. We guarantee 100% store credit on all stolen packages. For fraud, internal errors order; customers will get fully refunded in the form of original payment and notified right away about cancellation. For insured packages that got damaged is 90% credit if merchandise was sent back, 70% if kept. Packages that are uninsured will get 50% store credit if merchandise is kept or 90% store credit if merchandise was sent back. We do not refund 10% for shipping cost for both insured and uninsured. If order was not insured and the merchandise was not sent back a incur of 50% credit is non-refundable and will not be reimbursed due to no coverage for damages and fees. We are sorry that this is not an ideal solution for everyone, and we sympathize with anyone who've faced or will face this matter. It is not our choice or our doing to experience any of these dilemmas. Ever so often these instances occur, and it is unfortunate also unavoidable, therefore our focus of being proactive is all about being prepared for these type of mishaps. It is essential for us to build and maintain a great rapport with our customers. We will reimburse/credit all orders that fall under this no-fault rule. We understand that instances of fraud, damages and stolen packages are out of  customer’s control, therefore we have this rule in place for such occurrence. We believe this option will give a little ease and aid in the loss, so it will not be a complete and absolute one. In instances like these it is very strenuous on both parties since both parties suffer the loss therefore, we empathize with every customer that have had this experience. Dealing with delivery and shipping companies issues may arise beyond our control.
